Terms of Use
Persons under the age of 16 need the consent of their parents to use Ridely.
Welcome to Ridely (the “Services”) provided to you by Ztabler AB, registration number 559070-0935, with address KlippvÃĪgen 25 B, 756 52 Uppsala, Sweden (“we” or “us”). Your use of Ridely is governed by these Terms of Use. If you do not agree to these Terms of Use, please do not use Ridely.
Username and password
To use the Services, you must create a user account and log in to the app. You can choose a username and password, but you can also choose one of the available social media accounts listed in Ridely from time to time, to log in to your user account in the app.
If you choose to create a new user account, the username and password you choose may not be: harmful, abusive, racist, ethnic or sexual offensive, defamatory, infringing on any intellectual property, or infringing on someone’s privacy. We have the right to change your username and / or password if these, in our opinion, violate these Terms of Use.
When you create a user account, you will be asked to share certain information about yourself such as: your name, last name, email, gender and photo. The information will be used to provide the Services to you.
If you use another account to access your Ridely user account, such as your Facebook account, you grant us the right to obtain your verification information, such as username, encrypted login information, and other information that may be available at or below such ways to access the Services, including your name, last name, profile picture and email address. We may store such information and use it for the purposes stated in our personal data policy (available under the gearwheel of the app) and we may check your login details with such providers or other providers through which you access the Services.
When you create a user account in Ridely, you undertake to comply with these Terms of Use. You also agree to our processing of your personal data, which is done in accordance with our personal data policy (available under the gearwheel in the app).
Your user account is personal and you may not transfer your account to any third party. You are responsible for protecting your login information from unauthorized access, and you will not (intentionally or negligently) disclose your login information to any third party or otherwise allow any third party to use your user account or access to Ridely.
If you have reason to believe that any third party has gained access to Ridely, please notify us immediately. We have the right, but not the obligation, to suspend access to your user account if we have reason to believe that any third party has been granted unauthorized access to your user account.
Please note that we have the right to close your user account if it has been inactive for a period of 365 consecutive days.
Your subscription for Ridely PRO
This section applies when you have purchased a subscription to Ridely PRO. By paying the subscription fee you get access to Ridely PRO. There are three different types of subscriptions: 3 months, 12 months and lifetime. If you have not had Ridely PRO before, there is a 7 days free trial (this is only applicable in the mobile app, not on website). You can cancel your subscription any time during the trial without cost, until 24 hours before the trial ends.
If you choose to subscribe to Ridely PRO on the website, you will be charged through our payment provider Stripe. The subscription will renew automatically 24 hours before it expires. You can cancel your subscription by logging in to your account and clicking cancel on your subscriptions page.
If you subscribe through AppStore or Google Play, you need to cancel your subscription via Subscriptions on your account in AppStore or Google Play. Please note that uninstalling the app on your phone or terminating your account does not automatically stop a subscription you have on Ridely PRO. You must actively cancel your subscription.
Your subscription cannot be canceled before the period is over, that is, if you have purchased Ridely PRO for three months and terminate your subscription, it will only end when the third month is over.
You can cancel your subscription at any time. Your subscription will continue to work until the subscription period ends.
Code of conduct
User Content
You can upload text, images, videos and other information (“User Material”) in Ridely. You are responsible for all User Materials that you upload in Ridely.
You agree and warrant that you will not publish, transmit, distribute or upload any material on Ridely that:
(a) is incorrect, misleading or false;
(b) promote or encourage illegal activity;
(c) is racially or ethnically abusive and / or constitutes agitation against a minority (such as a national or ethnic group);
(d) constitutes defamation, contains pornography or is otherwise sexually abusive;
(e) constitutes an attack on sexual orientation or religion or is otherwise discriminatory; or
(f) is in any way harmful, infringing, offensive or illegal or infringing any third party’s rights (including but not limited to copyright and trademarks).
You accept and warrant that you will not, and will not allow any third party to:
(a) use Ridely to transfer or upload files or other content containing viruses, Trojans, corrupted data, malicious software, and other programs that may damage computers and other property;
(b) use Ridely to defame, harass, discriminate or threaten another person or otherwise infringe another person’s rights;
(c) distribute or reproduce all or part of Ridely,
(d) modify, disassemble or decompile any part of Ridely, unless expressly permitted by mandatory law;
(e) use software that reads data from Ridely automatically;
(f) use Ridely to request or encourage other users to violate any provision of these Terms of Use;
(g) abusing Ridely or using the App for any unauthorized or unauthorized purpose (which includes the promotion of computer viruses or the use of Ridely in a manner that infringes or infringes on the rights of others).
Ridely allows you to send messages to other users. You are responsible for all messages that you send when using Ridely and you guarantee that you will not send messages in violation of these Terms of Use, nor harass or threaten other users.
If you receive notices, photos or videos that you believe constitute a violation of these Terms of Use, or otherwise believe that Ridely is being used for illegal purposes or for purposes that do not comply with these Terms of Use, please contact us at info@ridely.com. We reserve the right to immediately remove content on Ridely which we, in our sole discretion, do not consider in accordance with these terms of use or policies or which is otherwise harmful to us or our users.
Links from the app
Please note that all information you provide on the third party website (and not directly Ridely), eg. through the use of social media or other accounts to log in to the Services, will be shared with the owners of the third party website. Your information will be subject to the privacy policy and terms of use of such third party website.
Limitation of liability
Ridely is provided in its existing condition without any warranty whatsoever and your use of Ridely is your sole responsibility. We make no representations, direct, implied or otherwise, regarding the availability, quality, fitness of any particular purpose, suitability or accuracy of Ridely.
There may be situations where Ridely will not be available, including but not limited to, maintenance and circumstances beyond our control, for which we are never responsible.
Processing of personal data
We process personal data that we receive in connection with the use of the Services. Personal data is processed in accordance with our personal data policy (available under the gearwheel in the app).
Immaterial rights
Content
You understand and agree that Ridely contains material provided by us and third parties and that such material may contain intellectual property rights. You agree to respect all intellectual property rights, including but not limited to copyrights, trademarks and trade names (whether registered or not) included or exhibited at Ridely or accessed in connection with Ridely.
You may only use the content of Ridely for your own use and you may not use the content of Ridely in violation of applicable law or these Terms of Use. You may use such content solely for the purpose of using the Services.
You do not obtain any other license to use the above intellectual property rights except as expressly stated in these Terms of Use.
You understand and agree that content posted on Ridely may belong to third parties, and that we have no control over such content. Therefore, you understand and agree that we shall not be held responsible for any content provided by third parties and displayed or available on Ridely.
User Content
When using Ridely, you have the option to upload User Material. Ownership of all User Material belongs to you, or the third party that owns such User Material. You hereby grant us a worldwide, non-exclusive, royalty-free and transferable right to store, publish, distribute, stream, transmit, replay, encode, copy, present, display and otherwise use the User Material to provide and market the Website and Services.
You warrant that you have all necessary rights to display and upload the User Material, to use the User Material in all other ways and to grant us a license to the User Material as above.
In the event that any User Material infringes any third party’s intellectual property, you agree to immediately remove all infringing parts of the User Material and indemnify us for all damages, costs and expenses we incur as a result of such infringement.
If we become aware of, or have reason to suspect, that User Material infringes any third party’s intellectual property rights, we have the right, but not an obligation, to remove all such User Material from Ridely and may temporarily or permanently suspend access to your User Account.
Injury and limitation of liability
You are liable to us for any damage sustained by us, or any third party, for your violation of these Terms of Use, including but not limited to, abuse of Ridely. Furthermore, you agree to indemnify us in relation to all claims, costs (including reasonable legal costs), damages, expenses and losses that we have incurred in any way in relation to your violations of these Terms of Use.
To the extent permitted by mandatory legislation, we will not be liable to you or any third party for any direct, indirect or other damages of any kind, including, but not limited to, loss of profits, loss of revenue, reduced turnover, discontinuance of operations or loss of goodwill that arises due to or in connection with these Terms of Use or the inability to use Ridely. We are not responsible to you for any third party claims directed against you.
Changing the terms and termination of the services
We have the right to change these Terms of Use. We will notify you of such changes no later than thirty (30) days before any change takes effect. We will provide you with such information under the gearwheel of the app or via email to the email address provided by you.
You have the right to cancel your user account from Ridely at any time and without prior notice. We have the right to suspend your access to Ridely with immediate effect if we have reason to believe that you violate these Terms of Use.
Furthermore, we reserve the right, at our sole discretion, to modify, cancel or temporarily or permanently discontinue our provision of Ridely without prior notice thereof, or as required by law or governmental decision. You agree that we will not be liable to you or any third party for such modification, interruption or termination.
Transfer
You may not assign or transfer any rights, obligations or licenses set forth in these Terms of Use. We may assign and transfer these Terms of Use without your consent and without notice to you.
Applicable law and disputes
These Terms of Use shall be governed by and construed in accordance with Swedish law, without application of the rules of choice. Any dispute or claim arising out of or in connection with these Terms of Use, or in the event of a breach, termination or invalidation thereof, shall finally be decided by the Swedish court, with Stockholm District Court as the first instance, unless otherwise provided by mandatory law.
